The law is stated as of January 31, 2012 Stare decisis is the cornerstone of the commonwealth system of jurisprudence. The use of judicial precedents is an indispensable foundation upon which to decide what is the law and its application to individual cases. Stare decisis provides a degree of certainty upon which individuals can rely in the conduct of their affairs, as well as a basis for orderly development of legal rules. The judicial hierarchy maintained by this doctrine ensures that the decisions of the Court of Appeal are binding on the High Court and all the lower courts.
