The law is stated as of January 31, 2012 Stare decisis is the cornerstone of the commonwealth system of jurisprudence. The use of judicial precedents is an indispensable foundation upon which to decide what is the law and its application to individual cases. Stare decisis provides a degree of certainty upon which individuals can rely in the conduct of their affairs, as well as a basis for orderly development of legal rules. The judicial hierarchy maintained by this doctrine ensures that the decisions of the Court of Appeal are binding on the High Court and all the lower courts. The decisions of the Court of Appeal of Brunei, its apex court, will clarify the approach that is to be taken in the lower courts when confronted with similar legal issues. This publication will facilitate the research of legal material for the Bench and Bar in Brunei as well as for the legal fraternity in other parts of the commonwealth.
