There is, at present, no specific statute on landlord and tenant in Malaysia. The law is contained partly in the National Land Code 1965 (which applies to Peninsular Malaysia only) and partly in a growing body of case law from this country and other common law countries. This book contains the essential elements of the law, focusing on the rights and obligations the landlord and the tenant (especially the tenant's right to have quiet enjoyment), defaults by tenants and landlord's remedies (especially distress actions and eviction proceedings) and rights of both parties upon termination. The law in Malaysia is pro-tenant, and a specific Landlord and Tenant Act is necessary to provide equal protection to both parties.
